In order to protect our chatters/users "The Fantasy Castle" reserves the right to disable or remove any user for any reason. Among the items listed below are a some of the activities, although this is not an all inclusive list, for which you may be banned or temporarily removed from the Fantasy Castle:
"The Fantasy Castle" has advertising agreements and fees. For advertising fees or to discuss possible agreements, please send an email to Lazarus for more infromation. However, posts and/or links leading to sites not under contract with "The Fantasy Castle" are prohibited and will be removed.
"The Fantasy Castle" provides product and/or services for entertainment purposes only. Fantasy Castle operates at cost and sometimes at a loss. If you become a member, you should consider it a donation in support of the site. "The Fantasy Castle" does not and never has provided membership refunds.
You understand that the discussions and postings in the Fantasy Castle Message Boards and Chat Rooms may involve language, content, images and themes of an adult or controversial nature.
You understand that all postings reflect the views of the authors and are not the views of "The Fantasy Castle". "The Fantasy Castle" has no obligation to delete discussions or postings that you may find objectionable or offensive but reserves the right to delete or remove any discussions or postings for any reason.
You have read and understood this Agreement. The terms of this Agreement will insure to the benefit of Fantasy Castle Productions, AlphaStar Productions, successors, assigns, and/or licensees.
IN NO EVENT WILL FANTASY CASTLE PRODUCTIONS, ALPHASTAR PRODUCTIONS, SUCCESSORS, ASSIGNS, AND/OR LICENSEES BE LIABLE TO YOU FOR ANY DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO, COMPENSATORY DAMAGES, LOST PROFITS, LOST DATA OR ANY FORM OF SPECIAL, INCIDENTAL, INDIRECT, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY KIND WHETHER BASED ON BREACH OF CONTRACT OR WARRANTY, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF FANTASY CASTLE PRODUCTIONS, ALPHASTAR PRODUCTIONS, SUCCESSORS, ASSIGNS, AND/OR LICENSEES IS INFORMED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES.
This Agreement will be governed by and construed in accordance with the laws of the State of Texas, without regard to your actual state or country of residence. Any waiver, amendment or other modification of any provision of this Agreement will be effective only if in writing and signed by "The Fantasy Castle". If for any reason a court of competent jurisdiction finds any provision or portion of this Agreement to be unenforceable, the remainder of this Agreement will continue in full force and effect. This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof, and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter.
"The Fantasy Castle" reserves the right to suspend or cancel service to a Customer at any time and without notice, for any reason, including, but not limited to, refusal or failure to pay for services provided or by sole judgment of "The Fantasy Castle" that the Customer may be performing activities harmful to "The Fantasy Castle" or its Customers, employees, vendors, business relationships or any other users of the Internet.
"The Fantasy Castle" reserves the right to change without notice the Terms of Service, including, but not limited to, access procedures, hours of operation, menu structures, commands, documentation, vendors and services offered.
"The Fantasy Castle" may modify its Terms of Service upon notice published online via the Fantasy Castle. Customer's use of "The Fantasy Castle" services after such notice shall constitute Customer's acceptance of the modifications to these policies.
